Super Duper Tennis Release, Waiver of Liability, and Participation Terms

At Super Duper Tennis, your child’s safety and your family’s clarity around our policies are important to us. This Release, Waiver of Liability, and Participation Terms applies to all participants enrolled in Super Duper Tennis classes, camps, clinics, private lessons, semi-private lessons, events, and related programming.
By registering for any Super Duper Tennis program, you confirm that you have read, understood, and agreed to the terms below.
1. Parent / Guardian Acknowledgement
I am the parent or legal guardian of the participant enrolling in Super Duper Tennis programs, activities, classes, camps, events, and services (collectively, the “Activities”).
I represent that I have the authority to enter into this agreement on behalf of the participant and myself.
2. Health Confirmation and Medical Responsibility
I certify that the participant has no known medical or other condition that would make participation unsafe or inappropriate, or that any such condition has been disclosed and appropriately managed.
I understand that I am responsible for informing Super Duper Tennis of any relevant medical conditions, allergies, behavioral concerns, or limitations before participation.
In the event of an emergency, I authorize Super Duper Tennis staff to secure emergency medical care for the participant if deemed necessary. I understand that I am solely responsible for any costs associated with such care.
I also understand and agree that Super Duper Tennis coaches and staff are not authorized to administer medication or EpiPens. For participants with allergies or medical conditions requiring monitoring or intervention, the parent or caregiver must remain present and fully responsible for care. This is consistent with the prior Super Duper Tennis release language.
3. Assumption of Risk
I understand that participation in tennis and related athletic activities involves inherent and unavoidable risks. These risks may include, without limitation:
physical exertion, slips, falls, collisions, being struck by balls or equipment, uneven or wet playing surfaces, weather conditions, participant interaction, transportation to and from activities, and exposure to communicable illnesses.
I understand that injuries may range from minor injuries such as bruises and strains to more serious injuries, including fractures, dislocations, illness, or other bodily injury. Both your prior waiver and current terms already state that tennis carries risk and that participants assume that risk.
I voluntarily assume all risks, known and unknown, connected with the participant’s attendance at and participation in the Activities.
4. Release of Liability
To the fullest extent permitted by law, I, individually and on behalf of the participant, hereby release, waive, discharge, and covenant not to sue Super Duper Tennis Inc., together with its owners, officers, directors, employees, contractors, coaches, agents, representatives, affiliates, licensors, successors, assigns, and partner facilities (collectively, the “Released Parties”), from and against any and all claims, demands, liabilities, damages, losses, costs, or expenses arising out of or related in any way to the participant’s participation in the Activities.
This release includes, without limitation, claims based on personal injury, illness, negligence, property damage, rights of privacy or publicity, defamation, or otherwise, except to the extent prohibited by applicable law.
This keeps the core protections from your original waiver and the lawyer-updated version.
5. Indemnification
I agree to indemnify, defend, and hold harmless the Released Parties from and against any and all claims, actions, demands, judgments, damages, losses, liabilities, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to:
the participant’s participation in the Activities,
the participant’s or parent/guardian’s acts or omissions, or
any breach of this agreement.
This indemnification language is consistent with the stronger protections included in the lawyer-revised form.
6. Supervision, Arrival, and Dismissal
Parents and caregivers are responsible for timely arrival and pickup.
Participants should arrive no more than 5 to 10 minutes before class. After class, participants will be released to a waiting parent or caregiver. Participants under age 3 must have a parent or caregiver present at all times. These points appear in both your prior waiver and current site terms.
For any activity designated by Super Duper Tennis as requiring a parent or caregiver to remain on site, the parent or caregiver must stay present for the duration of that activity.
7. Photo and Media Release
I understand that Super Duper Tennis and its agents may photograph, video, or otherwise record participants and accompanying parents or caregivers during classes, camps, events, or related activities.
I grant Super Duper Tennis the irrevocable right to use, reproduce, publish, display, and distribute such photographs, videos, and recordings, including the participant’s or accompanying adult’s name, image, likeness, voice, and appearance, for advertising, promotional, editorial, social media, website, and related business purposes, in any media now known or later developed, worldwide, without compensation.
I waive any right to inspect or approve the finished materials and waive any claim to compensation or similar rights arising from such use. This reflects both your old form and the expanded lawyer-drafted language.
8. Enrollment Rights
Super Duper Tennis reserves the right, in its sole discretion, to refuse, suspend, remove, or terminate any enrollment if continued participation is determined not to be in the best interest of the participant, other participants, staff, or the program.
That right already appears in your current terms.
9. Participation Policies Incorporated Into This Agreement
By registering, I acknowledge that I have also read and agree to Super Duper Tennis’ posted policies and terms, which are incorporated into this agreement by reference, including but not limited to policies regarding cancellations, refunds, makeups, class minimums, weather, attendance, credits, discounts, fees, waitlists, privacy, and related program rules. These policies are currently posted on your site.
Key current policies include:
Group class cancellations and refunds
Group classes may be canceled for low enrollment. Refund timing and processing fees currently vary by program type and timing of cancellation.
Private and semi-private lesson cancellation
Private and semi-private lessons are subject to a 24-hour cancellation policy.
Makeup policy
For missed group classes, participants are generally eligible for one end-of-season makeup class, with no refunds or credits for missed makeup opportunities.
Weather policy
Weather-related cancellations are made at Super Duper Tennis’ discretion, including based on forecasts, wet courts, drizzle, temperature, and school closure conditions. End-of-season makeup classes or limited credits may apply depending on the circumstances.
Class minimums
A minimum of 4 kids is currently required for a class to proceed.
Arrival and dismissal
Participants should arrive 5 to 10 minutes early, and children under 3 must have a caregiver present at all times.
10. Electronic Acceptance
I agree that checking the acceptance box during online registration and completing checkout constitutes my electronic signature and is legally binding to the same extent as a handwritten signature.
I further agree that this acceptance applies to the current registration and may be relied upon for future registrations unless Super Duper Tennis requires an updated acceptance.
This follows the electronic-signature approach in the revised lawyer-drafted form.
11. Governing Law and Venue
This agreement shall be governed by the laws of the State of New York, without regard to conflict of law principles. Any dispute arising out of or relating to this agreement or the participant’s involvement in the Activities shall be brought exclusively in the state or federal courts located in New York, New York, to the extent permitted by law.
I also waive any right to trial by jury to the fullest extent permitted by law.

12. Severability
If any part of this agreement is found unenforceable, the remaining provisions will remain in full force and effect.
13. Acknowledgement
BY REGISTERING, I ACKNOWLEDGE THAT I HAVE CAREFULLY READ THIS RELEASE, WAIVER OF LIABILITY, AND PARTICIPATION TERMS, AND THAT I UNDERSTAND AND AGREE TO BE LEGALLY BOUND BY IT ON BEHALF OF MYSELF AND THE PARTICIPANT.
